Payment terms

Payment will be due in full upon receipt of an invoice issued by the training organisation to the beneficiary.

Non-completion of the training service

In application of Article L6354-1 of the French Labour Code, it is agreed between the beneficiaries and the training organisation that, in the event of total or partial non-cancellation of the training service, the service provider must reimburse the co-contractor for any sums unduly received as a result.

Obligations and force majeure

 

In the context of its training services, "RASTELLI COMPANY" is bound by an obligation of means and not of result towards its Clients or Trainees. "RASTELLI COMPANY" cannot be held liable towards its Clients or Trainees in the event of non-performance of its obligations resulting from a fortuitous event or force majeure. Fortuitous events or force majeure are here considered to include, in addition to those habitually recognised by case law: illness or accident of a speaker or educational manager, strikes or social conflicts external to "RASTELLI COMPANY", natural disasters, fires, interruption of telecommunications, energy supply, or transport of any type, or any other circumstance beyond the reasonable control of "RASTELLI COMPANY".

 


Quote and certificate

 

For each training action, a quote is sent in duplicate by "RASTELLI COMPANY" to the Client. A copy duly completed, dated, stamped, signed and bearing the words "Bon pour accord" (Approved) must be returned to "RASTELLI COMPANY" by e-mail. If applicable, a specific agreement may be drawn up between "RASTELLI COMPANY", the OPCO or the Client. At the end of the training, "RASTELLI COMPANY" issues a training certificate to the Trainee. In the case of partial or full payment by an OPCO, "RASTELLI COMPANY" sends it a copy of the attendance sheet accompanied by the invoice. An attendance certificate for each Trainee can be provided to the Client, upon request.

 

Compensation, repair or withdrawal

In the event of cancellation by the beneficiary before the start of the training programme

  • Between 2 weeks and 1 week before the start of the training: 50% of the training cost is due.

  • Between 1 week and 48 hours before the start of the training: 75% of the training cost is due.

  • Less than 48 hours before the start of the training: 100% of the training cost is due.

The cost cannot be subject to a refund request or payment by the OPCO.

Intellectual property and copyright

All presentation sheets, content and educational materials in whatever form (paper, electronic, digital, oral, etc.) used by "RASTELLI COMPANY" to provide training or given to Trainees constitute original works and as such are protected by intellectual property and copyright. As such, the Client and the Trainee are prohibited from using, transmitting, reproducing, exploiting or transforming all or part of these documents, without the express agreement of "RASTELLI COMPANY". This prohibition applies, in particular, to any use made by the Client and the Trainee for the purpose of organising or leading training courses.

Description and training programme

The content of the programmes, as they appear on the training presentation sheets, are provided for information purposes only. The speaker or the educational manager reserves the right to modify them according to current events, the level of the participant(s) or the dynamic of the session.



Confidentiality and communication

 

"RASTELLI COMPANY", the Client and the Trainee undertake to keep confidential the documents and information to which they may have access during the training service or during exchanges prior to registration, in particular all elements appearing in the proposal sent by "RASTELLI COMPANY" to the Client. "RASTELLI COMPANY" undertakes not to communicate to third parties other than the partners with whom the training courses are organised and to the OPCOs, the information transmitted by the Client, including information concerning the Trainees. However, the Client agrees to be cited by "RASTELLI COMPANY" as a client of its training courses. To this end, the Client authorises "RASTELLI COMPANY" to mention its name, its logo and an objective description of the nature of the services in its lists of references and proposals to its prospects and clientele, interviews with third parties, activity reports, website, and in the event of legal, regulatory or accounting provisions requiring it.

 



Protection and access to personal information

 

The training organisation undertakes to inform each Trainee that:

- personal data concerning them is collected and processed for the purpose of monitoring the validation of the training and improving "RASTELLI COMPANY"'s offer

- In accordance with law no. 78-17 of January 6, 1978, the Trainee has a right to access, modify, rectify personal data concerning them. The Trainee may exercise this right by writing to: "RASTELLI COMPANY" or by electronic means to: "RASTELLI COMPANY".

In particular, "RASTELLI COMPANY" will retain data related to the Trainee's progress and assessment of acquired skills for a period not exceeding the duration necessary for the assessment of the training. Finally, "RASTELLI COMPANY" undertakes to erase, at the end of the exercises, any image that may have been taken by any video means during practical work or simulations.


Disputes

If a dispute or disagreement cannot be settled amicably, the Court of Bordeaux shall have sole jurisdiction to settle the dispute.
